On August 15, 2024, the Federal Trade Commission (FTC) and the State of Arizona Office of the Attorney General jointly filed a lawsuit against Coulter Motor Company, an Arizona-based auto dealership. The legal action centers on accusations of deceptive and discriminatory practices in the dealership’s advertising, pricing, and sales processes. Coulter Motor Company, like other dealerships facing similar FTC lawsuits, has denied the allegations but has agreed to pay $2.6 million to settle.

How will the CFPB’s proposed expansion for auto loan data collection impact dealerships?

One year after the conclusion of the Auto Finance Data Pilot project, in January the Consumer Financial Protection Bureau proposed an expansion of data collected from lenders servicing direct and indirect auto loans. If the proposal succeeds, auto lenders servicing 20,000 loans or more per year would be required to report expanded details about each loan underwritten, including details regarding dealership margin, fees and F&I products included in indirect loans.
